Buying a flat, plot or house in Gurugram involves more than paying the price and signing papers. Ownership passes only when a properly stamped sale deed is executed and registered before the Sub-Registrar, and the records are then updated in the buyer's name. This is how the process usually runs.
1. Verify the title before you pay
Registration records a transaction; it does not cure defects in the seller's title. Before an advance is paid, check:
- the chain of title documents going back a reasonable number of years;
- revenue records such as the jamabandi and mutation entries, for land;
- for colony, builder or society property — the licence, approvals, allotment and conveyance papers;
- whether the property is mortgaged, attached or the subject of litigation.
2. The agreement to sell
An agreement to sell records the price, payment schedule, timelines and conditions. It does not itself transfer ownership, but it binds the parties and is the basis for a suit for specific performance if one side defaults.
3. Stamp duty and registration fee
Stamp duty in Haryana is charged on the higher of the agreed consideration and the collector rate notified for the location. Rates are notified by the State Government and can differ between urban and rural areas and for women purchasers, so they should be confirmed for the specific property at the time of purchase. Duty is paid through e-stamp, and a registration fee is payable in addition.
4. Supporting certificates
Depending on where the property is, the Sub-Registrar may require additional documents — for example, a no-dues certificate and property ID from the municipal body for urban property, or permissions that apply to the area. Arranging these early avoids last-minute cancellation of the appointment.
5. Appointment and execution
An appointment is booked online on the Haryana registration portal. On the appointed day the buyer, the seller and two witnesses appear before the Sub-Registrar with original identity documents; photographs and thumb impressions are taken and the deed is registered.
6. After registration: mutation
The buyer should then apply for mutation (intkal) in the revenue records for land, or for transfer in the municipal records for urban property, and update property-tax and utility connections. Keep the original registered deed in safe custody.
