Relinquishment Deed

Release of a co-owner’s share in inherited or jointly held property in favour of the other co-owners.

When property is inherited, every legal heir acquires a share. A relinquishment (release) deed lets one co-owner give up their share in favour of one or more of the other co-owners — commonly used to consolidate inherited property in the name of one family member.

A release of a share in immovable property must be registered, and it usually cannot be undone once executed, so each heir’s share and the effect of the release should be clear beforehand. The chambers verifies the succession position, drafts the deed and assists with registration and mutation.

Frequently asked questions

A relinquishment deed operates only in favour of existing co-owners. To transfer a share to someone who is not a co-owner, a sale deed or gift deed is used instead.

Not unilaterally. It can be challenged in court only on limited grounds such as fraud, coercion or misrepresentation.

The information on this page is general in nature and is not legal advice. Stamp duty, fees and requirements are set by the authorities and can change; they are confirmed for each matter.
