Gurugram has one of the busiest rental markets in the country, for homes as well as offices and shops. A clear written agreement protects both owner and tenant — and avoids the most common disputes over deposits, repairs and exit.
When must a lease be registered?
Under Section 107 of the Transfer of Property Act, 1882, a lease of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent, can be made only by a registered instrument. An unregistered document that required registration cannot be relied on to prove the lease itself.
Why 11-month agreements are common
Agreements for less than a year do not require compulsory registration, which is why many residential arrangements are written for eleven months and renewed. They must still be properly stamped, and they deserve the same care in drafting as a long lease.
Clauses worth negotiating
- Rent, due date and annual escalation
- Security deposit and the conditions for its refund
- Lock-in period and notice period for termination
- Maintenance charges, repairs and who pays for what
- Permitted use, sub-letting and alterations
- Condition of the premises at handover, with an inventory
Tenant verification
Owners in Gurugram are required to get their tenants verified by the police. Verification can usually be completed online through the Haryana Police citizen services portal or at the local police station, and should be done when the tenant moves in.
Commercial leases
Office and retail leases are usually longer and need registration. They also call for attention to fit-out and rent-free periods, signage, assignment and the consequences of early exit.
